The Office for Human Research Protections was correct in determining that the consent forms for the National Institutes of Health -sponsored SUPPORT study were seriously flawed. Several articles defended the consent forms and criticized the OHRP's actions. Disagreement focuses on three central issues: how risks and benefits should be described in informed consent documents; the meaning and application of the concept of “standard of care” in the context of research; and the proper role of OHRP. Examination of the consent forms (...) reveals that they failed to disclose the reasonably foreseeable risks of the experimental interventions in the study, as well as the potential for differences in the degree of risk between these interventions. Although the concept of “standard of care” may be helpful in determining the ethical acceptability of other aspects of research, such as clinical equipoise, it is not helpful in discussing consent requirements. This paper evaluates four recent randomized clinical trials in which the informed consent of participants was either not sought at all, or else was conducted with critical information missing from the consent documents. As these studies have been taking place, various proposals to conduct randomized clinical trials without consent have been appearing in the medical literature. Some of the explanations offered for why it is appropriate to bypass consent or disclosure requirements appear to represent a fundamental misunderstanding of applicable government (...) regulations and even the research enterprise. Others are the result of conceptual disagreements about the importance and application of traditional research ethics norms to ‘comparative effectiveness research’ and modern research environments. Common among these explanations, however, is a failure to appreciate when a research intervention, rather than merely an observation or review of data, is taking place. Review committees and investigators are failing to see, or choosing to ignore, interventions in the lives of research subjects. When these studies have come to light, government agencies with oversight authority have done little or backed down. Prestigious medical journals have published research results knowing that the required consent was not obtained, or they have stood by the published studies even after the inadequacy of consent is discovered. This article critically examines this erosion of consent in theory and practice and calls for restoring the requirement of informed consent to its proper place as a priority in human subjects research. In her ‘Spracherwerb’(2012) Ruth Millikan gives a compelling account of language acquisition based on our ability to track objects. I argue that, and how, it is undermined by her insistence on equating understanding language utterances and sense perception, point to idealist hazards, and plead against propositionality and for imagism in order to safeguard the account’s important potential for giving a comprehensive explication of meaning.

A specific form of research question, for instance, “What is the probability of a certain class of weather events, given global climate change, relative to a world without?” could be answered with the use of FAR or RR (Fraction of Attributable Risk or Risk Ratio) as the most common approaches to discover and ascribe extreme weather events. Kevin Trenberth et al. (2015) and Theodore Shepherd (2016) have expressed doubts in their latest works whether it is the most appropriate explanatory (...) tool or the way of public outreach concerning climate events and extremes. As an alternative, these researchers focus on complementary questions, for example, “How much did climate change affect the severity of a given storm?” advocating a “storyline” approach. New methods and new research questions are neither foreign, nor controversial from the standpoint of history and philosophy of science, especially those, related to public interest. Nevertheless, the new proposal has got a tepid reception from the majority of professionals of the given field. They argued that this approach can cause weakening of standards and neglecting of scientific method. The following paper attempts to find the roots of the supposed controversy. We claim inefficiency of uncompromising approach to D&A in absolute sense and assert that errors of a particular type may have a different level of concern in society, depending on the variety of contexts. Therefore, context defines the risk of over-estimation vs. under-estimation of harm. (shrink)

In an attempt to learn from COVID-19, this essay features six responses to the question: what did COVID-19 teach us, expose in us, or purge out of us when it comes to spiritual formation in Christ? Each response was written independently of the others by one of the coauthors. Diane J. Chandler focuses in on how COVID-19 exposed grievous inequities for ethnic groups in the American church and broader society. Kelly M. Kapic reminds us of the goodness of human finitude (...) and how COVID restrictions have forced many of us to embrace our limitations. Siang-Yang Tan reflects on eight lessons he has learned during this pandemic year in his role shepherding a local church. James C. Wilhoit calls us to consider the structures that are needed for local church leadership to make wise and godly decisions in times of crisis. Richard Peace draws our attention to what might be learned from the forced monasticism brought about by COVID-19 quarantines. Finally, Ruth Haley Barton pauses to consider the interdependence of human life that has been dramatically illustrated by this pandemic. While these six responses certainly do not exhaust all there is for the church to learn from COVID, we present them in the spirit of “O Lord, teach us what we do not see” and hope they will inspire your own reflections. This essay argues that the book of Ruth's reopening of Israel's history and national mythology functions in such a way as to redeem, as it were, the plight of the subaltern Moabite—a plight begun with the daughters of Lot in Genesis 19. A parallel is then drawn with the 1619 Project, the recent journalistic project which posits the entire historical sweep of African slavery in North America since 1619 as the defining arc of the United States' founding. As theoretical (...) frames, the essay draws on the work of literary critic Gayatri Chakravorty Spivak (including her concept of “moral love”) and political philosopher Arash Abizadeh. In so doing, the essay illustrates how a “functionalist” approach to biblical ethics that balances the content of the biblical narrative with attention to how the text functions in its broader context can provide guidance for contemporary ethical application. This essay introduces and discusses four musical works that extensively treat Ruth and Naomi's relationship: two late nineteenth-century oratorios, and two twentieth-century operas. Both music and librettos are treated as midrash—a creative retelling through both altered text and in the language of music.

Recent statistics in South Africa shows that women mostly experience poverty as compared to their male counterparts. In the context of the experience of poverty by women, several Old Testament scholars have convincingly explored the theme of poverty in the Hebrew Bible. In her contextual rereading of the Naomi-Ruth Story, Madipoane Masenya links the issue of poverty to the theme of land. Also, from the historical-critical and partly, the contextual approach to ancient texts, Esias E. Meyer argues that (...) Leviticus 25:8-55 holds liberating possibilities for women who are invisible in such a text. Based on the argument made by the preceding scholars, firstly, this article argues that in the context from which the texts of Ruth 4 and Leviticus 25:8-55 emerged, some women were both landless and poor. Secondly, it is argued in this article that the context of these texts carries a striking resemblance to the situation of women in modern South Africa, as many women do not own productive land and are poor. Thirdly, this article poses the question: What implications do the ideologies of Ernesto 'Che' Guevara and the hermeneutical approach of Fernando F. Segovia to ancient texts bear on the reading of Ruth 4 and Leviticus 25:8-55 in South Africa? (shrink)

When thinking about the intersection of care and Christian bioethics, it is helpful to follow closely the account of Ruth, who turned away from security and walked alongside her grieving mother-in-law to Bethlehem. Remembering Ruth may help one to heed Professor Kaveny?s summoning of Christians to remember ?the Order of Widows? and the church?s historic calling to bring ?the almanahinto its center rather than pushing her to its margins.? Disabled, elderly and terminally ill people often seem, at least (...) implicitly, expendable. By hearing the scriptural account of Jesus? steadfast great-grandmother, readers may recall another way. One may read Ruth?s care for Naomi as a performative, prophetic act of faith. Ruth?s faithful resolve, when set next to Orpah?s prudent way, challenges the notion that a bioethic of care is innately feminine, and may further call women and men corporately to participate in a kind of care that is strenuous work. This article explores Ruth’s theology of resilience amidst vulnerability: a resilience rooted in ḥesed. Ḥesed is a powerful social force that could address current issues for those both in privileged positions and in vulnerable situations. A re-reading of Ruth offers modern theologians and serious students of the Bible pathways towards building resilience amidst vulnerability, and in caring for those in vulnerable positions. The text at hand offers a pathway to be true to one’s core values and character, even (...) amidst desperate situations. In Ruth resilience is developed by caring for others, identifying with a particular faith community, and taking initiatives while maintaining integrity. The narrative unveils a sustainable life of resilience that happens when one’s private and public life is lived congruently to each other. This article also reads Ruth’s narrative through a lens of a minority foreign woman that uses feminist and post-colonial approaches while looking at Ruth through a hermeneutic of trust. First, the author identifies her assumptions and considerations. Secondly, the article examines resilience as rooted in one’s identity and explores ḥesed under cultural and spiritual frameworks, within the narrative of Ruth and Naomi’s road scene from Moab to Bethlehem. Lastly, it examines resilience as rooted in ḥesed, within the narrative of the threshing floor scene encounter between Ruth and Boaz. The road and threshing floor scenes are decisive moments for Ruth. Her words and actions in each instance reveal her resilience: her strength of mind, emotion, and spirit, in spite of her vulnerability. (shrink)

The Shape of Agency offers interlinked explanations of the basic building blocks of agency, as well as its exemplary instances. The first part offers accounts of a collection of related phenomena that have long troubled philosophers of action: control over behaviour, non-deviant causation, and intentional action. These accounts build on earlier work in the causalist tradition, and undermine the claims made by many that causalism cannot offer a satisfying account of non-deviant causation, and therefore fails as an account of intentional (...) action. The second part turns to modes of agentive excellence—ways that agents display quality of form—providing a novel account of skill, including an account of the ways that agents display more or less skill. Shepherd discusses the role of knowledge in skill, and concludes that while knowledge is often important, it is inessential. This leads to a discussion of the way that knowledge of action and knowledge of how to act informs action execution. Knowledgeable action includes a unique epistemic underpinning: in knowledgeable action, the agent has authoritative knowledge of what she is doing and how she is doing it when and because she is poised to control her action by way of practical reasoning. It seems obvious that phenomenally conscious experience is something of great value, and that this value maps onto a range of important ethical issues. For example, claims about the value of life for those in a permanent vegetative state, debates about treatment and study of disorders of consciousness, controversies about end-of-life care for those with advanced dementia, and arguments about the moral status of embryos, fetuses, and non-human animals arguably turn on the moral significance of various facts about consciousness. However, (...) though work has been done on the moral significance of elements of consciousness, such as pain and pleasure, little explicit attention has been devoted to the ethical significance of consciousness. In this book Joshua Shepherd presents a systematic account of the value present within conscious experience. This account emphasizes not only the nature of consciousness, but the importance of items within experience such as affect, valence, and the complex overall shape of particular valuable experiences. Shepherd also relates this account to difficult cases involving non-humans and those with disorders of consciousness, arguing that the value of consciousness influences and partially explains the degree of moral status a being possesses, without fully determining it. The upshot is a deeper understanding of both the moral importance of phenomenal consciousness and its relations to moral status. In this chapter we reflect on questions about the nature and sources of agentive phenomenology – that is, the set of those experience-types associated with exercises of agency, and paradigmatically with intentional actions. Our discussion begins with pioneering work in psychology and neuroscience that dates to the early 80s (section 1). As we will see, much of the current work on agentive phenomenology in both psychology and philosophy draws motivation from this work, and the questions it raises. In the influential 1995 article “Social Conditions as Fundamental Causes of Disease,” Bruce Link and Jo Phelan described social and political factors as “fundamental causes” of death and disease. Whitney Pirtle has recently declared racial capitalism another such fundamental cause. Using the case of the water crisis in Flint, Michigan, she has argued that racial capitalism's role in that situation meets each of the criteria Link and Phelan's article outlines: racial capitalism influenced multiple disease outcomes, affected disease outcomes through multiple (...) risk factors, involved access to flexible resources that can be used to minimize both risks and the consequences of disease, and was reproduced over time through the continual replacement of intervening mechanisms. We argue for Pirtle's conclusion using the extensive literature on racial capitalism and case studies concerning housing in the United States and Brazil and what Naomi Klein has termed “corona capitalism” in India. If races correspond to hierarchies of material security, as suggested by Ruth Wilson Gilmore, then these hierarchies and their causal effects are fundamental determinants of public health. (shrink)

Ethics for Disaster addresses the moral aspects of the aftermath of natural disasters such as hurricanes, earthquakes, and tornadoes. The book explores how these catastrophes illuminate the existing inequalities in society, combining a unique philosophical approach with new moral thinking. Zack stresses the obligation of both individuals and government in preparing for and responding to dangerous times, forcefully arguing for the preservation of normal moral principles even in times of crisis and national emergency.

We are morally obligated to plan for disaster because it affects human life and well-being. Because contemporary disasters affect the public, such planning should be public in democracies and it should not violate the basic ethical principles of normal times. Current Avian Flu pandemic planning is restricted to a response model based on scarce resources, or inadequate preparation, which gives priority to some lives over others. Rather than this model of ‘Save the Greatest Number,’ the public would be more ethically (...) served by a model of ‘Save All Who Can Be Saved,’ which is based on adequate preparation. The Moral Limits of Law analyzes the related debates concerning the moral obligation to obey the law, conscientious citizenship, and state legitimacy. Modern societies are drawn in a tension between the centripetal pull of the local and the centrifugal stress of the global. Boundaries that once appeared permanent are now permeable: transnational legal, economic, and trade institutions increasingly erode the autonomy of states. Nonetheless transnational principles are still typically effected through state law. For law's subjects, this tension brings into focus (...) the interaction of legal and moral obligations and the legitimacy of state authority. This volume incorporates a comprehensive critical analysis of the methodology and substance of the debates in recent legal, political, and moral philosophy, regarding political obligation and the moral obligation to obey the law. The author argues that traditional accounts of political obligation that assume a bounded conception of the polity are no longer tenable. Incentives are typically conceived as a form of trade, and so voluntariness appears to be the only ethical concern. As a consequence, incentives are often considered ethically superior to regulations because they are voluntary rather than coercive. But incentives can also be viewed as one way to get others to do what they otherwise would not; that is, as a form of power. When incentives are viewed in this light, many ethical questions arise in addition to voluntariness: What are the (...) responsibilities of the powerful in using incentives? Can incentives be manipulative or exploitative, even if people are free to refuse them? Like all other forms of power, incentives can be abused. This paper develops criteria for distinguishing their legitimate from their illegitimate uses, viz. legitimacy of purpose, voluntariness, and effect on character. Positive law and problems with identifying beneficiaries confine reparations for U.S. slavery to the level of discourse. Within the discourse, the broader topic of rectification can be addressed. The rectification of slavery includes restoring full humanity to our ideas of the slaves and their descendants and it requires disabuse of the false biological idea of race. This is not racial eliminativism, because biological race never existed, but more importantly because African American racial identities and redress of present racism are based (...) on lifeworlds of race in contrast with which the biological idea has been an external imposition. In this interview, Ruth Klüger, writer and survivor of Auschwitz, speaks of the wound of who, once alive outside the lager, has felt a “feeling of rejection” by the world that she thought it would have accepted her – as if the fault of the executioners had contaminated the victims. A separation that the survivor will live for all her life, both because, as a matter of fact, she feels to have a “double citizenship” between the alive and the (...) dead – such that all in a sudden the normality breaks down and it gives way to the “old world” and the sensation that anything can be subtracted away – and because the witnesses, after having been rejected, they have turned into a generation of martyrs, object of a worship that can easily turn into nausea. However, the reflection on the human conditions cannot do away with the identification with what is acknowledged as similar, and for that reason a proximity is necessary. (shrink)

Deciding to undergo a predictive genetic test is difficult. The patient has no symptoms that might tip the balance in favor of the test, and knowledge of the information might have significant implications for her physical and mental health, her family, and her financial position. Furthermore, although the decision to undergo many medical tests might reasonably be said to be the patient's own business, it could be argued that predictive genetic tests are different. Dean Bell and Belinda Bennett argue that (...) genetic information has a “shared” or “familial” character due to the likelihood of it affecting others. If others might be affected by the results of your test, then it is certainly plausible to suggest that they have an interest in knowing the information. If that is the case, then it could also be argued that they are entitled to be considered when you are deciding whether to undergo a test. (shrink)
